How long can you be held without a preliminary hearing, before your rights have been violated? ?

In the Commonwealth of Virginia...See my husband is in jail...He got in trouble when he was 16 and they held that against him...so there is no bond...Every bond hearing we went to the story has changed...and all the other charges except the "big" charges have been dropped...however his court date isn't until end of February, and he will have been in there for 5 months...we hired an Attorney, thinking that it would help...but he is the one that continued it from December 8th to then! This is all so crazy...I can't get any answers from anyone because we don't even have the right to file any motions....We have three kids and I am losing everything I have...if anyone has any advise, I sure would appreciate hearing it...
